Was required to use this service for a property sale. Up to the point of settlement i found the conveyancer helpful. However, the organisation had been instructed that court orders applied to the distribution of sale proceeds and all funds should be retained in trust. The instructions were not followed and no-one at the organisation checked for or requested the court orders prior to distributing funds (without seeking instructions or consent). I had been given incomplete settlement figures. I had informed I would not be available on the day of settlement when a second set of settlement figures that were again incorrect were emailed through. Settlement funds were distributed to a third party who was not a seller or purchaser and in doing so, no due diligence or checks to verify third party misrepresentations were made but money was handed over to a third party making representations (who was obliged to provide a copy of orders but did not) without seeking instructions or consent or checking for or reading court orders. Upon pointing out the error the service has continued to deprive a party of settlement funds despite readily handing over money without instructions or consent to a third non party who failed to disclose important information such as court orders. The experience has resulted in being deprived of money owed pursuant to court orders and depriving people of the ability to live and rehouse themselves and in contravention of court orders. I believe the service should be reviewed and investigated.
