What is conveyancing?

Conveyancing is the process of legally transferring ownership from the seller to the buyer in real estate transactions. This transfer is rigorous and requires legal oversight to be completed smoothly. The process typically goes like this:

  1. Contract Preparation or Review
    Sellers work with a conveyancer to prepare the contract of sale and ensure their interests are reflected in that document. Buyers should have the contract reviewed before signing.

  2. Negotiation & Exchange of Contracts
    Once terms are agreed upon, both parties sign and exchange contracts. At this stage, the buyer pays a deposit (typically 10%).

  4. Searches, Enquiries & Legal Checks
    Buyers’ legal representatives conduct searches and raise enquiries. Sellers respond and provide any necessary documentation.

  5. Finance & Settlement Preparation
    Buyers finalise loan approvals and prepare funds. The buying and selling parties then sign the documents and agree on a settlement date.

  6. Final Inspection (Buyers)
    Buyers typically carry out a final inspection shortly before settlement to ensure the property is in the agreed condition.

  7. Settlement
    On settlement day, funds are transferred, and legal ownership changes hands. The buyer then receives the keys, and the seller receives the funds from the sale.

  8. Post-Settlement
    The buyer’s name is registered on the title. Both parties’ legal representatives finalise any remaining paperwork.

Unfortunately our experience with Bush to Beach Legal was not reflective of the positive reviews online. There was a period of over a month that we had no contact from our conveyancer and it was only following us reaching out a day prior to settlement thanks to our broker raising the alarm that it appears relevant settlement documents were generated. We were given less than 24 hours notice of what funds were required to complete settlement. If we had not reached out the day prior to settlement, it remains unclear whether we would have heard from our conveyancer at all. This was an unnecessarily unpleasant and stressful experience.
