When buying or selling property in Emerald, environmental factors are often front of mind. The town has a history of flooding from the Nogoa River and Fairbairn Dam releases, and many rural holdings in the region are subject to land use restrictions, mining activity, or agricultural considerations. These risks make environmental disclosure a key part of the conveyancing process.

From 1 August 2025, Queensland’s new seller disclosure laws apply to all property sales, including in Emerald. Sellers must provide a completed Form 2 Disclosure Statement along with prescribed certificates before a contract is signed. Importantly, the form requires disclosure of matters such as zoning, heritage listings, and whether the land is on the Contaminated Land Register or Environmental Management Register. For Emerald buyers, this is particularly relevant given the area’s mix of mining, farming, and residential development.

However, not every risk is covered by the new regime. Sellers do not have to disclose flood history, past building approvals, or structural defects. This means buyers in Emerald should still carry out their own due diligence, such as flood searches, building and pest inspections, and enquiries about water supply or rural land use.
