Here’s What You Need to Know
About the New Disclosure Rules
The Queensland Government has introduced a new law to make property sales in Queensland more transparent. Under the Property Law Act 2023, from the 1st of August 2025, all contracts for the sale of residential property in Queensland must include a Seller’s Disclosure Statement. Sellers must provide prospective buyers with important information about the property before they sign a contract.
The Seller Disclosure Statement must include key documents like title searches, zoning information, and any easements or restrictions. These changes bring Queensland in line with other states like New South Wales, Victoria, and the ACT, which already have similar rules for the sale of residential property.
What does this mean for sellers?
If you’re selling a residential property, you must:
- Provide a signed Seller Disclosure Statement
- Include required certificates and search results
- Give this to the buyer before they sign the contract
The Seller Disclosure Statement replaces the ‘buyer beware’ approach and is intended to reduce surprises, protect buyers, and make property transactions transparent and smoother for both parties.
What You Need to Know About New Seller Disclosure Statement
An accurate and current Seller Disclosure Statement must be given to the buyer before they sign the contract or they may have the right to terminate before settlement.
A Seller’s Disclosure Statement must include key documents, such as title searches, zoning and planning details, flood or environmental risks, and any easements or restrictions on the property.
What is a Seller's Disclosure Statement
A Seller’s Disclosure Statement is a document prepared by the seller that is legally required to be given to the buyer before they sign a contract. It contains important information about the residential property that could influence the buyer’s decision to go ahead with the purchase.
From 1 August 2025, this statement will be legally required under Queensland’s new property laws and sellers will be required to disclose key facts about the property.
All documents and details must be accurate and current at the time of disclosure and include key certificates and searches that reveal things like:
- Title Search showing the registered owner and any encumbrances
- Details of easements, covenants, and access rights
- Planning and zoning information, including any restrictions or notices
- Rates notice and body corporate information (if applicable)
- Environmental factors, such as flooding or bushfire risks
- Rates notice and body corporate records (if applicable)
- Certificates or searches prescribed by the regulations (e.g. rates notice, sewerage diagrams)
Why It's Important
Failing to provide a complete and accurate Seller Disclosure Statement to the buyer can have serious consequences:
- Buyers may be entitled to terminate the contract, even after signing
- Delays and disputes may arise during the conveyancing process
- A failure to disclose could result in financial loss or a failed settlement
