What is conveyancing?

Conveyancing is the process of legally transferring ownership from the seller to the buyer in real estate transactions. This transfer is rigorous and requires legal oversight to be completed smoothly. The process typically goes like this:

  1. Contract Preparation or Review
Sellers work with a conveyancer to prepare the contract of sale and ensure their interests are reflected in that document. Buyers should have the contract reviewed before signing.

  2. Negotiation & Exchange of Contracts
Once terms are agreed upon, both parties sign and exchange contracts. At this stage, the buyer pays a deposit (typically 10%).

  3. Cooling-Off Period (for Buyers)
Buyers usually have a 5-business-day cooling-off period unless waived. Sellers cannot back out once contracts are exchanged.

  4. Searches, Enquiries & Legal Checks
Buyers’ legal representatives conduct searches and raise enquiries. Sellers respond and provide any necessary documentation.

  5. Finance & Settlement Preparation
Buyers finalise loan approvals and prepare funds. The buying and selling parties then sign the documents and agree on a settlement date.

  6. Final Inspection (Buyers)
Buyers typically carry out a final inspection shortly before settlement to ensure the property is in the agreed condition.

  7. Settlement
On settlement day, funds are transferred, and legal ownership changes hands. The buyer then receives the keys, and the seller receives the funds from the sale.

  8. Post-Settlement
The buyer’s name is registered on the title. Both parties’ legal representatives finalise any remaining paperwork.

Both sellers and buyers should engage their own conveyancers who will act in their best interest throughout the conveyancing process, including representing you in contract negotiations and conducting legal searches and checks on your behalf.

Kim from Bush to Beach legal assisted us with our first home purchase. She took the time to explain things to us and answer all of our questions. You can sometimes hear about the settlement period being stressful, but Kim ensured the process was stress free and very smooth. She was very responsive whether that was via text, phone or email. Our initial contact with Luke was also great and again he took the time to answer all our questions. We will definitely be contacting Kim for our next purchase.

What to look out for when buying property in Byron Bay

Byron Bay is one of Australia’s most sought-after regions in the whole country, with a wide variety of properties, from beachfront apartments and modern townhouses to character homes and holiday rentals.

Just south of the town centre, Suffolk Park is a popular area, offering a relaxed community feel close to the beach. Whether you’re buying or selling, working with a knowledgeable conveyancer Suffolk Park can make the process straightforward and stress-free.

For those seeking a rural escape, Wilsons Creek offers stunning hinterland properties, often with larger land sizes and scenic surrounds. These types of purchases can involve additional legal considerations, making it important to engage a local conveyancer Wilsons Creek who understands the area and its unique property landscape.

Our conveyancers with regional expertise can help navigate everything from title issues to land zoning and Byron Shire Council requirements.
